Music Mogul Privacy Policy

Music Mogul (“Music Mogul, “we,” “our” or “us”) respects the privacy of our online visitors and is committed to creating a safe environment while you use our products and services. To demonstrate this commitment, we have adopted the following Privacy Policy (“Policy”). This Policy explains the use of information collected via our Websites and the Music Mogul service. As used in this Policy, the term “personal information” means any information that may be used to identify an individual, including, but not limited to, a first and last name, gender or age, home or other physical address, a computer’s IP address, an email address, phone number or other contact information, whether at work or at home. Please read this information carefully - we urge all consumers to take an active role in helping us protect their privacy by becoming aware of the policies they encounter. Please also be advised that this Policy applies to all users of our Websites, including those who may be under the age of 13 (“children”). There are five principles guiding this privacy policy:

1. We collect personal information and usage statistics to maintain a high-quality customer experience and deliver superior customer service.

2. Some information we request directly from you during registration. Other pieces of data are gathered indirectly from website traffic, your computer hardware and Internet connection, or Music Mogul usage.

Except under certain limited circumstances set forth here and in our terms of service posted at http://musicmogul.com/serviceterms, Music Mogul does not disclose personal information you provide it to any third parties without your permission. Music Mogul may disclose your personal information if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Music Mogul, this Website or any user of Music Mogul; (b) protect and defend the rights or property of Music Mogul, the Music Mogul virtual world or the users of Music Mogul; or (c) act in urgent circumstances to protect the personal safety of users of this Website, Music Mogul or the public. In addition, if Music Mogul should ever file for bankruptcy or merge with another company, we may sell the information you provide to us on this site to a third party or share your personal information with any company with whom we merge.

4. You will have the ability to update the personal data you provided to us during registration by contacting us at support@musicmogul.com.

5. We will update this Privacy Policy in a timely fashion when any changes occur.

The Policy currently applies to all Websites owned and operated by Music Mogul and that post a direct link to this Policy. Presently these Websites include: http://musicmogul.com (collectively, the “Websites”).

In addition, this Policy applies only to information, if any, provided to us by consumers online through the Websites listed above. This Policy does not cover information that may be collected by Music Mogul offline. It also does not cover information that may be submitted to us solely in a business capacity, such as personal information contained in résumés from job applicants or requests from the media.

Please be aware that while you are visiting our Websites, you may be given the opportunity to link to other sites that are maintained by other companies or organizations, such as our licensees or licensors. These third party sites are beyond our control, and we are not responsible for the practices or content of such sites. When you link to another site from our Websites, this Privacy Policy no longer applies. We recommend that you read the privacy policy of the third party website to which you have linked before you provide any personal information to that site.

The Information We Collect and How We Collect It
 There are different levels of information we collect, depending upon your relationship to Music Mogul.

• Anonymous Website Visitor: If you visit our Websites we automatically record information related to your IP address, computer configuration, Music Mogul cookie information, and aggregate information on what content you access or visit. This information is collected in the background while you move around our Website.

• Mailing List Member: If you choose to provide us personal information in order to subscribe to our electronic mailing list, we collect information to aid delivery and preferences such as e-mail address and message performance statistics.

• Registered Website Member: If you choose to register on our Website, we will track broad site usage information as well as aggregate usage of website community features such as downloads and forums. This is in addition to the personal data collected during the registration process.

• Music Mogul User: If you register as a Music Mogul user, we collect and aggregate a variety of data to monitor system performance, and to verify your unique identity. This includes specific and general information about your computer hardware and Internet connection (including your IP address), which are stored together but are not personally identifiable. We track usage of customer-service resources in order to ensure high quality interactions. This is in addition to the personal data and billing information collected during the registration process.

• Additionally there are a few special situations to note:
o Former Registered User: If you cease being a customer of ours, we will keep a copy of your registration file in our database for use in the event you   wish to rejoin the Music Mogul service.
o Response to Job Postings or Unsolicited Communications: Please note that information we receive in reference to a job posting or via unsolicited          communications is not covered under the terms of this Policy.
o Individuals Outside of the United States: Anyone using the Music Mogul Websites from outside of the United States should be aware that personal              Information collected on these Websites may be stored and processed in the United States or any other country in which Music Mogul or its affiliates,        subsidiaries or agents maintain facilities, and by using these Websites, you consent to any such transfer of information outside of your country.

Information Displayed to Other Users

 Information about your account may be displayed to other users in your Music Mogul profile, and this same information may be available through automated script calls and application program interfaces. This information includes your account name, account type, the date your account was established, whether or not you are currently online, user rating information, group and partner information, and whether or not you have established a payment account or transaction history with Music Mogul. However, we will not display your actual name, address, or credit card or bank account numbers, except with your express permission or as otherwise permitted by this Privacy Policy and our terms of service.

Disclosing Personal Information in Profiles, Forums or within Music Mogul
 
You may choose to disclose personal information in our online forums, via your Music Mogul profile, directly to other users in chat or otherwise while using the Music Mogul service. Please be aware that such information is public information and you should not expect privacy or confidentiality in these settings.

How We Protect Your Personal Data
 
We comply with applicable laws and industry standards when transferring, receiving and storing consumer data. Access to your personal information is limited to those Music Mogul employees who require the information in order to provide products or services to you or perform their jobs.

Only Those 13 or Older May Register
 
Music Mogul recognizes the importance of protecting children online. Music Mogul does not collect information from children ages 12 or younger because only those individuals who are 13 years of age or older are permitted to register. Registration for our mailing list, Website and/or Music Mogul service requires entry of a valid and eligible Date of Birth.

Compliance with Children's Online Privacy Protection Act

In compliance with the Children's Online Privacy Protection Act ("COPPA"), we do not collect any Personal Information from children under thirteen (13) years of age except where permitted by law. Generally, our Websites target an audience that is over the age of thirteen (13) and some content may not be appropriate for all ages. Parental supervision is recommended. If you are the parent or guardian of a child under thirteen (13) and believe that he or she is using the Music Mogul Website please contact us at support@musicmogul.com. Upon request, the parent or guardian of a child under thirteen (13) may review and request the deletion of such child's Personal Information, as well as refuse to permit the further collection or use of such Personal Information.

Your Consent
 
Periodically we may need to update this Policy to reflect changes in the types of information we collect, the means we use to collect information, and/or our usage of collected information. When this occurs, we will make reasonable efforts to alert you to these changes. Your use of the Music Mogul Websites and/or any Music Mogul products or services (including without limitation Music Mogul) noted above signifies your assent to this Music Mogul Privacy Policy.

California Residents

Residents of the State of California, under certain provisions of the California Civil Code, have the right to request from companies conducting business in California a list of all third parties to which the company has disclosed Personal Information during the preceding year for direct marketing purposes. Alternatively, the law provides that if the company has a privacy policy that gives either an opt-out or opt-in choice for use of your Personal Information by third parties for marketing purposes, the company may instead provide you with information on how to exercise your disclosure choice options. Sulake has opted for the alternative option and therefore provides you with the opportunity to opt-out or opt-in to the use of your Personal Information by third parties for direct marketing purposes. Therefore, we are not required to maintain or disclose a list of third parties that received your Personal Information for marketing purposes.

Contests, Sweepstakes and Promotions
 
Music Mogul may occasionally present a special contest, sweepstakes or promotion ("Promotion") that is sponsored by Music Mogul or another company. To qualify for entry in that Promotion, we may ask you to provide Personal Information including your name, age, gender, and address. If we plan to share that information with the sponsor(s) or with others, we will provide a statement to that effect in the Promotion terms, and provide you with an ability to opt-in or opt-out of sharing at your Personal Information other then for purposes of operating the Promotion. You may also need to agree to the official rules for a Promotion, which may contain specific requirements of you, including, except where prohibited by law, allowing the sponsor(s) of the Promotion to use your name, voice and/or likeness in advertising or marketing associated with the Promotion.

Information Shared with Outside Companies

In addition to sharing information with sponsors as described above, we may also disclose information in the event of a merger, acquisition, re-organization, bankruptcy, or other similar event, or in the good faith belief that we are required to do so by law or to protect the safety of rights (including intellectual property rights) of Music Mogul, our business partners, consumers, or the general public.

By using our Websites, you acknowledge that you have read and agree to the terms of this Policy. If you do not agree to these terms, please do not use our Websites. We reserve the right to make changes to this Privacy Policy at any time. If we make any changes, we will update the effective date of the Policy or post the date of the most recent updates or revisions were made. Music Mogul generally keeps this Privacy Policy posted online and you should review it frequently, as it may change from time to time without notice. Any changes will be effective immediately upon the posting of the revised Privacy Policy. WHEN YOU ACCESS THE SITE, YOU AGREE TO THIS PRIVACY POLICY. IF YOU DO NOT AGREE TO THIS PRIVACY POLICY OR TO ANY CHANGES WE MAY SUBSEQUENTLY MAKE, IMMEDIATELY STOP ACCESSING THE MUSC MOGUL SITE. If, at any point, we decide to use your Personal Information in a manner materially different than what was stated at the time it was collected, we will notify users of this change by e-mail to the last e-mail address provided to us.
